This Terms and Conditions (“Statement“ or “Terms“) governs our relationship with users (“Business owner“) and others who interact whether as a guest or a registered user with PlanOut Dubai website, PlanOut Dubai service made available by PlanOut Dubai (“we“) as well as PlanOut Dubai brands and products, which we call PlanOut Dubai services (together, “Service“, “Services“).

Acceptance of Terms and Conditions

1. By accessing or using any of PlanOut Dubai services you agree to be bound by these Terms and Conditions (“Terms and Conditions”). This may be updated from time to time.

1. You must accept and abide by these terms as presented to you: any changes, additions or deletions by user/s are not acceptable

1. We reserve the right, in our sole discretion, to change these Terms and Conditions (“Updated Terms”) from time to time. Unless we make a change for legal or administrative reasons, we will provide reasonable advance notice before the Updated Terms become effective. You agree that we may notify you of the Updated Terms by posting them on the Service, and that your use of the Service after the effective date of the Updated Terms (or engaging in such other conduct as we may reasonably specify) constitutes your agreement to the Updated Terms. Therefore, you should review these Terms and Conditions and any Updated Terms before using the Service. The Updated Terms will be effective as of the time of posting, or such later date as may be specified in the Updated Terms, and will apply to your use of the Service from that point forward. These Terms and Conditions will govern any disputes arising before the effective date of the Updated Terms. Customers are encouraged to frequently visit these sections in order to be updated about the changes on the website and apps.

1. When Terms and Conditions have been changed. If you do not agree to any change to the Terms then you must immediately stop using any of PlanOut Dubai services

1. PlanOut Dubai may refuse access to the website for noncompliance with any of the terms of this agreement.

1. Because PlanOut Dubai provides a wide range of services, we may ask you to review and accept supplemental terms that apply to your interaction with a specific app, product, or service. The supplemental terms associated with the app. product or service govern with respect to your use of such to the extent of conflict.

1. If you breach any of the terms in this legal notice, your permission to use the Service automatically terminates and you must immediately destroy any downloaded or printed extracts from the Service.

1. If you do not agree to be bound by all these Terms and Conditions, do not access or use the services.

1. Additionally, you will find resources at the end of this document that help you understand how PlanOut Dubai works.

The governing law is United Arab Emirates law.

Proprietary

Rights

1. You must not change, modify, adapt, alter or translate the Service or change, modify, alter or translate another website so as to falsely imply that it is associated with the Service or PlanOut Dubai.

1. You may not copy, distribute, reproduce, sell, lease, assign, rent, sublicense, encumber any aspect of the content.

1. You also may not modify or create derivative works of any aspect of the Website or any Content, other than with respect to your own Content.

1. You must not access PlanOut Dubai private API by means other than those permitted by PlanOut Dubai.

1. You must not use domain names or web URLs in your username without prior written consent from PlanOut Dubai.

1. You may not disassemble or decompile, reverse engineer or otherwise attempt to discover any source code contained in the App, Website or any software or database connected to PlanOut Dubai services.

1. You must not interfere or disrupt the Service or servers or networks connected to the Service, including by transmitting any worms, viruses, macro viruses, trojan horses, worms, logic bombs, spyware, malware or any other code of a destructive or anything else designed to interfere with, interrupt the normal operating procedures of a computer. You may not inject content or code or otherwise alter or interfere with the way any PlanOut Dubai page is rendered or displayed in a user’s browser or device.

1. We reserve the right to force forfeiture of any username for any reason.

1. We may, but have no obligation to, remove, edit, block, and/or monitor Content or accounts containing Content that we determine in our sole discretion violates these Terms and Conditions. PlanOut Dubai may but is not limited to;
  1. issue warnings, suspend, terminate or attach conditions to your access and/or removing any materials from the website.

1. We prohibit crawling, scraping, caching or otherwise accessing any content on the Service via automated means, including but not limited to, user profiles and photos (except as may be the result of standard search engine protocols or technologies used by a search engine with PlanOut Dubai’s express consent).

1. Some of the Service is supported by advertising revenue and may display advertisements and promotions, and you hereby agree that PlanOut Dubai may place such advertising and promotions on the Service or on, about, or in conjunction with your Content. The manner, mode and extent of such advertising and promotions are subject to change without specific notice to you.

1. You acknowledge that we may not always identify paid services, sponsored content, or commercial communications as such.

1. The Service contains content owned or licensed by PlanOut Dubai (“PlanOut Dubai Content”). PlanOut Dubai Content is protected by copyright, trademark, patent, trade secret and other laws, and, as between you and PlanOut Dubai, PlanOut Dubai owns and retains all rights in the PlanOut Dubai Content and the Service. You will not remove, alter or conceal any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the PlanOut Dubai Content and you will not reproduce, modify, adapt, prepare derivative works based on, perform, display, publish, distribute, transmit, broadcast, sell, license or otherwise exploit the PlanOut Dubai Content.

We will use reasonable endeavours to verify the accuracy of any information that we make available either directly or through any website partners wherever practical however we are not in a position to ensure the complete accuracy of information that can often change such as for instance opening times, dates of performances, schedules and current prices and we strongly recommend that prior to relying on information made available through the Website or mobile applications, such information where capable of change is confirmed with the applicable venue, facility or service provider.

PlanOut Dubai name and logo are trademarks of PlanOut Dubai shall remain at all times owned by us or our licensors, and may not be copied, imitated or used, in whole or in part, without the prior written permission of PlanOut Dubai. In addition, all page headers, custom graphics, button icons and scripts are service marks, trademarks and/or trade dress of PlanOut Dubai, and may not be copied, imitated or used, in whole or in part, without prior written permission from PlanOut Dubai.

1. You are permitted to use this material only as expressly authorised by us.

1. Except in accordance with our brand guidelines, available here:
  1. 1. Provide clear attribution to PlanOut Dubai.
  1. 1. Make sure PlanOut Dubai content has enough visual separation from other social media content.
  1. 1. Use the logos on our Contents section only. Avoid trademarks, names, domain names, logos or other content that could be confused with PlanOut Dubai.
  1. 1. Don’t use the PlanOut Dubai brand in a way that implies partnership, sponsorship or endorsement. This includes combining any part of PlanOut Dubai brand with a company name, marks or with other generic terms, as well as making PlanOut Dubai the most distinctive or prominent feature of your design.
  1. 1. Don’t use any of our logos in your brand identity, which includes your icon, logo or your product design.
  1. When you’re talking about your presence on PlanOut Dubai or how your product is integrated with PlanOut Dubai, always capitalize the word PlanOut Dubai and never modify or abbreviate the word. Remember to display the word PlanOut Dubai in the same font size and style as the content surrounding it, and never use any of the logos to replace the word PlanOut Dubai in a sentence.

User Accounts

1. You must be at least 21 years old to use the Service.

1. We do not knowingly collect or solicit personal information from anyone under the age of 21 or knowingly allow such persons to register. If you are under 21, please do not attempt to register on this website. Nor send any information about yourself to us, including your name, address, telephone number or email address. No one under age 21 may provide any personal information to or on this website. In the event that we learn that we have collected personal information from a child under age 21 without verification of parental consent, we will delete that information as quickly as possible. You may not have to be a member to participate in certain parts of the Website but you must meet the designated minimum age requirements for the specific matter.

1. In order to use our app, you will need to create an account. You must never use or share another user’s account. You must provide full and accurate information when you create your account with us. You are solely responsible for the activity that occurs on your account and so we suggest that you keep your account password secure. You must notify us immediately if you are aware of any unauthorised use of your account. You can do this by sending us an email on info@planoutdubai.com

1. You can login or create an account via social network accounts or with an email address and secure password. When logging in or creating an account via a social network PlanOut Dubai will ask the nominated application for permission to access selected data, which enables the service to work. This data is stored by PlanOut Dubai against your profile. You can choose what personal information is displayed on PlanOut Dubai. When you login to using social networks the application will check for any changes and update your PlanOut Dubai profile accordingly and stored by PlanOut Dubai. Additionally, if you amend details about yourself within your account profile this data will be retained as the master copy of your data. If you choose to deactivate your PlanOut Dubai account all your data will be deleted from PlanOut Dubai.

1. You may not post violent, nude, partially nude, discriminatory, unlawful, infringing, hateful, pornographic or sexually suggestive photos or other content via the Service.

1. You are responsible for any activity that occurs through your account and you agree you will not sell, transfer, license or assign your account, username, or any account rights. With the exception of people or businesses that are expressly authorized to create accounts on behalf of their employers or clients, PlanOut Dubai prohibits the creation of and you agree that you will not create an account for anyone other than yourself. You also represent that all information you provide or provided to PlanOut Dubai upon registration and at all other times will be true, accurate, current and complete and you agree to update your information as necessary to maintain its truth and accuracy.

1. You agree that you will not solicit, collect or use the login credentials of other PlanOut Dubai users.

1. You are responsible for keeping your password secret and secure.

1. You must not defame, stalk, bully, abuse, harass, threaten, impersonate or intimidate people or entities and you must not post private or confidential information via the Service, including, without limitation, your or any other person’s credit card information, social security or alternate national identity numbers, non-public phone numbers or non-public email addresses.

1. You may not use the Service for any illegal or unauthorized purpose. You agree to comply with all laws, rules and regulations applicable to your use of the Service and your Content (defined below), including but not limited to, copyright laws.

1. You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, applications, links and other content or materials (collectively, “Content”) that you submit, post or display on or via the Service.

1. You must not create accounts with the Service through unauthorized means, including but not limited to, by using an automated device, script, bot, spider, crawler or scraper.

1. You must not create or submit unwanted email, comments, likes or other forms of commercial or harassing communications (a/k/a “spam”) to any PlanOut Dubai users.

1. You must not attempt to restrict another user from using or enjoying the Service and you must not encourage or facilitate violations of these Terms and Conditions or any other PlanOut Dubai terms.

We may now or in the future like a venue, event, photo, videos, DJ or any other content, by submitting this you agree that the like is based on your own experience and is your genuine opinion, that you have no personal or business relationship with what you are ‘liking’ and have not been offered any incentive or payment to like a venue, event, photo, videos, DJ or any other content.

Content

1. You are solely responsible for your interaction with other users of the Service, whether online or offline. You agree that PlanOut Dubai is not responsible or liable for the conduct of any user. PlanOut Dubai reserves the right, but has no obligation, to monitor or become involved in disputes between you and other users. Exercise common sense and your best judgment when interacting with others, including when you submit or post Content or any personal or other information.

1. PlanOut Dubai does not claim ownership of any Content that you post on or through the Service. Instead, you hereby grant to PlanOut Dubai a non-exclusive, fully paid and royalty-free, transferable, sub-licensable, worldwide license to use the Content that you post on or through the Service.

1. You represent and warrant that: (i) You own the Content posted by you on or through the Service or otherwise have the right to grant the rights and licenses set forth in these Terms and Conditions; (ii) the posting and use of your Content on or through the Service does not violate, misappropriate or infringe on the rights of any third party, including, without limitation, privacy rights, publicity rights, copyrights, trademark and/or other intellectual property rights; (iii) you agree to pay for all royalties, fees, and any other monies owed by reason of Content you post on or through the Service; and (iv) you have the legal right and capacity to enter into these Terms and Conditions in your jurisdiction.

1. You agree that PlanOut Dubai is not responsible for, and does not endorse, Content posted within the Service. PlanOut Dubai does not have any obligation to prescreen, monitor, edit, or remove any Content. If your Content violates these Terms and Conditions, you may bear legal responsibility for that Content.

1. It is PlanOut Dubai’s policy not to accept or consider content, information, ideas, suggestions or other materials other than those we have specifically requested and to which certain specific terms, conditions and requirements may apply. This is to avoid any misunderstandings if your ideas are similar to those we have developed or are developing independently. Accordingly, PlanOut Dubai does not accept unsolicited materials or ideas, and takes no responsibility for any materials or ideas so transmitted. If, despite our policy, you choose to send us content, information, ideas, suggestions, or other materials, you further agree that PlanOut Dubai is free to use any such content, information, ideas, suggestions or other materials, for any purposes whatsoever, including, without limitation, developing and marketing products and services, without any liability or payment of any kind to you.

1. As between you and PlanOut Dubai, any Content will be non-confidential and nonproprietary and we will not be liable for any use or disclosure of Content. You acknowledge and agree that your relationship with PlanOut Dubai is not a confidential, fiduciary, or other type of special relationship, and that your decision to submit any Content does not place PlanOut Dubai in a position that is any different from the position held by members of the general public, including with regard to your Content. None of your Content will be subject to any obligation of confidence on the part of PlanOut Dubai, and PlanOut Dubai will not be liable for any use or disclosure of any Content you provide.

Although it is PlanOut Dubai’s intention for the Service to be available as much as possible, there will be occasions when the Service may be interrupted, including, without limitation, for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and/or equipment. Also, PlanOut Dubai reserves the right to remove any Content from the Service for any reason, without prior notice. Content removed from the Service may continue to be stored by PlanOut Dubai, including, without limitation, in order to comply with certain legal obligations, but may not be retrievable without a valid court order. Consequently, PlanOut Dubai encourages you to maintain your own backup of your Content. In other words, PlanOut Dubai is not a backup service and you agree that you will not rely on the Service for the purposes of Content backup or storage. PlanOut Dubai will not be liable to you for any modification, suspension, or discontinuation of the Services, or the loss of any Content. You also acknowledge that the Internet may be subject to breaches of security and that the submission of Content or other information may not be secure.

Copyright and Trademark Violations

1. We respect other people’s rights and expect you to do the same.

1. If you repeatedly infringe other people’s intellectual property rights, we will disable your account when appropriate.

When creating a profile, information entered by business owners, promoters and DJs must comply with the following:
1. 1. Do not violate any laws regarding unfair competition, anti-discrimination or false advertising; and
1. 1. are not obscene or pornographic; and
1. 1. are not defamatory, libellous, unlawfully threatening or unlawfully harassing; and
1. 1. displayed phone numbers, email addresses and urls must be accurate; and
1. 1. do not infringe any third party’s intellectual property rights (including without limitation copyright and/or trademarks), other proprietary rights or rights of publicity or privacy; and
1. 1. do not violate any law, statute, ordinance or regulation; and
1. is user-friendly – No profanity, threats, prejudiced comments, hate speech, sexually explicit language, or other content that is not appropriate for other users

Third Parties

1. You acknowledge that when using PlanOut Dubai mobile applications or Website, you may be exposed to third party websites and that we are not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such. You further understand and acknowledge that you may be exposed to third party websites that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against us with respect thereto.

1. PlanOut Dubai website may contain hyperlinks to websites and resources owned and operated by third parties. These third party websites and resources have their own Terms and Conditions and privacy policies which you will need to comply with. We have no control over third party websites or resources and we are not responsible for the availability of such websites and resources. We do not accept any responsibility or liability for any third party websites and resources and your access and use of such services and content is at your own.

1. You may choose, at your sole and absolute discretion and risk, to use applications that connect the Service or your profile on the Service with a third-party service (each, an “Application”) and such Application may interact with, connect to or gather and/or pull information from and to your Service profile. By using such Applications, you acknowledge and agree to the following: (i) if you use an Application to share information, you are consenting to information about your profile on the Service being shared; (ii) your use of an Application may cause personally identifying information to be publicly disclosed and/or associated with you, even if PlanOut Dubai has not itself provided such information; and (iii) your use of an Application is at your own option and risk, and you will hold PlanOut Dubai parties harmless for activity related to the Application.

You agree that you are responsible for all data charges you incur through use of the third party Service.

Links to other websites

1. Third party links do not imply that we endorse, are affiliated or associated with any linked website, or are legally authorised to use any intellectual property accessible through such links.

1. There may be links from the Service, or from communications you receive from the Service, to third-party web sites or features. There may also be links to third-party web sites or features in images or comments within the Service. The Service also includes third-party content that we do not control, maintain or endorse. Functionality on the Service may also permit interactions between the Service and a third-party web site or feature, including applications that connect the Service or your profile on the Service with a third-party web site or feature. For example, the Service may include a feature that enables you to share Content from the Service or your Content with a third party, which may be publicly posted on that third party’s service or application. Using this functionality typically requires you to login to your account on the third-party service and you do so at your own risk. PlanOut Dubai does not control any of these third-party web services or any of their content. You expressly acknowledge and agree that PlanOut Dubai is in no way responsible or liable for any such third-party services or features. Your correspondence and business dealings with third parties found through the service are solely between you and the third party.

1. Through PlanOut Dubai Services you have the opportunity to acquire promotions, goods products and services, make bookings for venues and events and obtain other benefits and enter into commercial transactions (“e-commerce transactions”). e-commerce transactions are available both from PlanOut Dubai and from PlanOut Dubai’s commercial partners (“Transactional Partners”). It is important to note that where you enter into e-commerce transactions you will be required to enter into separate Terms and Conditions in respect of such transaction directly with Transactional Partners. In the event that you enter into e-commerce transactions with PlanOut Dubai then the terms and conditions relating to such transactions are subject to PlanOut Dubai’s e-commerce Terms and Conditions.

PlanOut Dubai cannot be held responsible for any transaction that you enter into with a Transactional Partner.

Conditions

1. We reserve the right to modify, temporarily or permanently the Service or your access to the Service for any reason, without notice, at any time, and without liability to you.

1. If we terminate your access to the Service. Your photos, comments, likes, and all other data will no longer be accessible through your account (e.g., users will not be able to navigate to your username).

1. We will determine, in our discretion, whether there has been a breach of these Terms and Conditions through

1. Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

1. We exclude liability for actions taken in response to breaches of these Terms and Conditions. The responses described above are not limited, and we may take any other action we reasonably deem appropriate.

1. We shall not be liable to you or any third party for any modification to or withdrawal of PlanOut Dubai website

1. Upon termination, all licenses and other rights granted to you in these Terms and Conditions will immediately cease.

We reserve the right to refuse access to the Service to anyone for any reason at any time.

Disclaimer of warranties

License

1. If you want to share the content on our site with your friends we are happy for you to do so, but please use the sharing tools provided when available.

You are permitted to print and download extracts from the Website for your own use on the following basis:
1. 1. No documents or related graphics on the Website are modified in any way;
1. 1. No graphics on the Website are used separately from the corresponding text; and
1. Our copyright and trademark notices and this permission notice appears in all copies.

Our Liability

1. Our liability for losses you suffer as a result of us not adhering to these Terms and Conditions including deliberate breaches is strictly limited to the purchase price of the voucher you purchased and any losses which are a foreseeable consequence of us breaching these Terms and Conditions. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.
  1. 1. For death or personal injury caused by our negligence;
  1. 1. Under section 2(3) of the Consumer Protection Act 1987;
  1. 1. for fraud or fraudulent misrepresentation; or
  1. for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

1. We are not responsible for indirect losses which happen as a side effect of the main loss or damage and even if such losses result from a deliberate breach of these Terms and Conditions by us that would entitle you to terminate the contract between us, including but not limited to:
  1. 1. loss of income or revenue
  1. 1. loss of business
  1. 1. loss of profits or contracts
  1. 1. loss of anticipated savings
  1. 1. loss of data, or
  1. waste of management or office time however arising and whether caused by tort (including negligence), breach of contract or otherwise.

1. We will determine, in our discretion, whether there has been a breach of these Terms and Conditions through your use of our site. When a breach of these Terms and Conditions has occurred, we may take such action as we deem appropriate which may result in our taking all or any of the following actions:
  1. 1. Immediate, temporary or permanent withdrawal of your right to use our site.
  1. 1. Immediate, temporary or permanent removal of any posting or material uploaded by you to our site.
  1. 1. Issue of a warning to you.
  1. 1. Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach
  1. 1. Further legal action against you.
  1. Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of these Terms and Conditions. The responses described above are not limited, and we may take any other action we reasonably deem appropriate.

Purchasing Vouchers

1. Once purchased, the vouchers becomes non-refundable and non-exchangeable.

1. We negotiate and advertise offers (which are referred to in these Terms and Conditions as “Deals” or “Promos”) with various suppliers of goods and services on behalf of our customers. The Deals are conditional on certain requirements being met and specific terms and conditions related to them, which will be described in relation to any specific Deal on our service and on the corresponding voucher.

1. By purchasing an order through our site, you confirm that:
  1. 1. You are legally capable of entering into binding contracts; and
  1. 1. You are at least 21 years old; and
  1. You grant us an irrevocable non-exclusive licence to use for any purpose any content you post on our service

1. You will be charged in AED currency.

1. You may purchase vouchers by using your debit/credit card. We accept Visa and Mastercard.

1. We will charge your credit card, debit card or other method of payment as soon as you purchase a voucher.

1. We shall send to you as soon as reasonably practicable the voucher you offered to buy after receiving payment from you in respect of it.

1. The purchased voucher will become redeemable and will be available to print from the email sent.

1. PlanOut Dubai is the seller of the goods and/or services under the Deal or Promo and is solely responsible for ensuring the Deal or Promo and the goods and/or services are performed and comply with all applicable law.

1. PlanOut Dubai’s obligations under these Terms and Conditions are solely to issue the voucher to you under the Deal or Promo. PlanOut Dubai is not the seller of such goods and/or services and the Merchant is solely responsible for supplying such goods and/or services and redeeming any such voucher.

1. PlanOut Dubai disclaims any and all responsibility or liability in relation to the Deal or for any goods or services supplied in relation to it to the maximum extent permissible by law. Neither PlanOut Dubai nor its officers, employees or any third parties may be held liable whether in relation to contract, warranty, tort (including negligence), product liability, tax matters or any other form of liability for any claim, damage or loss, arising from or relating to the provision of all or any goods or services sold or agreed to be supplied pursuant to the Deal.

1. PlanOut Dubai may provide links on our site to the websites of other companies, whether affiliated with us or not. We cannot give any undertaking, that products you purchase from third party sellers, or from companies to whose website we have provided a link on our site, will be of satisfactory quality, and any such warranties are disclaimed by us absolutely.

1. This disclaimer does not affect your statutory rights against the third party seller and/or the Merchant.

1. We may disclose your customer information related to the voucher that you have purchased for the Deal to the Merchant.

1. The price of any voucher in relation to a Deal or Promo will be as quoted on our site from time to time, except in cases of obvious error.

1. We advise the cardholder to retain a copy of transaction records, policies and rules.

We do not trade with or provide any services to OFAC and sanctioned countries.

Our refund policy

1. In the event that the merchant cancels the Deal for a valid reason:
  1. 1. We shall cancel your voucher and you must also destroy any voucher held electronically or in printed form.
  1. A refund will be issued back into the bank account used.

1. We will process the refund due to you as soon as possible and, in any case, within 21 days of the day the voucher was cancelled. In this case, we will refund the price of the voucher in full.

1. For any other reason, at our discretion, we will notify you of such refund via e-mail within a reasonable period of time. We will endeavour to process the refund due to you as soon as possible.

1. We will refund any money received from you using the same method originally used by you to pay for your purchase.

1. In the unlikely event that the merchant has to cancel or reschedule the date for a voucher redeemable or a course due to events beyond PlanOut Dubai’s reasonable control, a full refund will be given to you.

In the unlikely event that the merchant has provided you with the incorrect type of voucher purchased, a full refund will be given to you.
1. PlanOut Dubai will not, however, refund travel, accommodation or any other costs that you may have incurred over and above the fee paid for the voucher.
